These Terms of Use govern access to and use of the Surch 360 platform, websites, applications and related services provided by Surch 360 Ltd. By registering for or using the platform, you confirm that you are acting on behalf of your business and agree to be bound by these Terms. Users must use the platform responsibly and in accordance with these Terms
The Surch 360 platform is provided for the purpose of delivering software tools and digital services to support recruitment, workforce management, training and related business activities. The platform enables customers to manage their own processes, data and workflows. Surch does not provide employment, legal, financial or professional advice, does not guarantee outcomes, and does not participate in or control decisions made by users when using the platform. All responsibility for how the platform is used, and for any decisions or actions taken as a result, remains with the customer.
Surch 360 is a business-to-business software platform supporting recruitment, workforce management, training and related services. The platform is not an employment agency or employment business and does not place candidates into employment.
Paid access to the platform is available only to businesses. Individuals seeking work may use certain features free of charge and do not enter into a paid contract with Surch. You confirm that you have authority to bind the business you represent.
Subscriptions are tiered and monthly rolling by default. Customers may choose to pay twelve months in advance at a discounted rate. This does not create a fixed term contract. Fees are payable in advance and are nonrefundable except where required by law.
Access to paid features is provided immediately upon subscription. Consumer cooling off rights do not apply. Cancellation prevents future billing only and does not entitle the customer to a refund for the active billing period.
Cancellation or downgrade takes effect at the end of the current billing period. Upgrades may take effect immediately or at the next billing cycle.
Each subscription tier includes a maximum number of active jobs. If a customer downgrades to a tier with a lower job allowance they must select which jobs to retain. Jobs exceeding the new allowance will be closed on a stated date.
Where a job is closed due to downgrade or cancellation all associated ATS candidate data will be permanently deleted and cannot be recovered. Job records may remain as empty drafts. Customers are notified before confirming any downgrade.
Users must not use the platform in a way that is unlawful, misleading or abusive. In particular, users must not:
Customers act as independent data controllers. Data retention is linked to subscription status and legal obligations. Surch processes data in accordance with its Privacy Policy.
Some services may be provided by third parties. AI tools provide guidance only and do not constitute professional advice.
Surch excludes liability for indirect or consequential loss. Total liability is limited to the greater of fees paid in the previous twelve months or ten thousand pounds.
These Terms are governed by the laws of England and Wales.
