Terms of Use – Surch 360

1. Introduction

    These Terms of Use govern access to and use of the Surch 360 platform, websites, applications and related services provided by Surch 360 Ltd. By registering for or using the platform, you confirm that you are acting on behalf of your business and agree to be bound by these Terms. Users must use the platform responsibly and in accordance with these Terms

2. Purpose of the Platform

    The Surch 360 platform is provided for the purpose of delivering software tools and digital services to support recruitment, workforce management, training and related business activities. The platform enables customers to manage their own processes, data and workflows. Surch does not provide employment, legal, financial or professional advice, does not guarantee outcomes, and does not participate in or control decisions made by users when using the platform. All responsibility for how the platform is used, and for any decisions or actions taken as a result, remains with the customer.

3. Platform Overview

    Surch 360 is a business-to-business software platform supporting recruitment, workforce management, training and related services. The platform is not an employment agency or employment business and does not place candidates into employment.

4. Eligibility and Use

    Paid access to the platform is available only to businesses. Individuals seeking work may use certain features free of charge and do not enter into a paid contract with Surch. You confirm that you have authority to bind the business you represent.

5. Candidate Use of the Platform

  • Individuals seeking employment or career opportunities (“Candidates”) may use certain areas of the platform free of charge. Candidates do not pay to access the platform, search for jobs or apply for roles, and do not enter into a paid contract with Surch.
  • Surch does not act as an employer, employment agency or employment business in relation to Candidates. Surch does not guarantee interviews, job offers, employment outcomes or responses from employers or recruiters. All hiring decisions are made solely by employers or recruiters using the platform.
  • Candidates are responsible for ensuring that all information provided through their profile, applications or communications is accurate, complete and lawful. Surch 360 does not verify Candidate information and accepts no responsibility for the accuracy or content of Candidate profiles.
  • By using the platform, Candidates acknowledge that their profile information and applications may be viewed by employers, recruiters or employment businesses and may be shared across job boards or services operated by Surch 360. Candidates may manage their profile visibility in accordance with available platform settings.
  • Surch 360 reserves the right to suspend or remove Candidate accounts or content where there is misuse of the platform, unlawful activity or breach of these Terms.

6. Subscription Model

    Subscriptions are tiered and monthly rolling by default. Customers may choose to pay twelve months in advance at a discounted rate. This does not create a fixed term contract. Fees are payable in advance and are nonrefundable except where required by law.

7. Immediate Access

    Access to paid features is provided immediately upon subscription. Consumer cooling off rights do not apply. Cancellation prevents future billing only and does not entitle the customer to a refund for the active billing period.

8. Cancellation Upgrades and Downgrades

    Cancellation or downgrade takes effect at the end of the current billing period. Upgrades may take effect immediately or at the next billing cycle.

9. Job Limits and Downgrades

    Each subscription tier includes a maximum number of active jobs. If a customer downgrades to a tier with a lower job allowance they must select which jobs to retain. Jobs exceeding the new allowance will be closed on a stated date.

10. ATS Data Removal

    Where a job is closed due to downgrade or cancellation all associated ATS candidate data will be permanently deleted and cannot be recovered. Job records may remain as empty drafts. Customers are notified before confirming any downgrade.

11. Prohibited Conduct

Users must not use the platform in a way that is unlawful, misleading or abusive. In particular, users must not:

  • Provide, upload or distribute content that is unlawful, obscene, defamatory, threatening or otherwise objectionable.
  • Introduce viruses, malware or any harmful code into the platform.
  • Interfere with, disrupt or place unreasonable demand on the platform, systems or networks.
  • Attempt to harvest, scrape, extract or collect data or content from the platform without authorisation.
  • Circumvent, attempt to bypass or misuse subscription tiers, usage limits or feature restrictions.
  • Access, retain or attempt to retain candidate data, ATS data or other platform data beyond the scope of the active subscription.
  • Share login credentials or allow unauthorised access to the platform and/or use the platform for purposes other than genuine recruitment, workforce management or related business activities.
  • Surch reserves the right to suspend or terminate access where prohibited conduct occurs.

12. Data Protection

    Customers act as independent data controllers. Data retention is linked to subscription status and legal obligations. Surch processes data in accordance with its Privacy Policy.

13. Third Party Services

    Some services may be provided by third parties. AI tools provide guidance only and do not constitute professional advice.

14. Limitation of Liability

    Surch excludes liability for indirect or consequential loss. Total liability is limited to the greater of fees paid in the previous twelve months or ten thousand pounds.

15. Governing Law

    These Terms are governed by the laws of England and Wales.
